Overview

This website (svlms.com) is operated by Mundida, a business based in Torbole Casaglia (BS), Italy (P. IVA IT04531990986). Throughout these Terms, the words "we", "us", and "our" refer to Mundida / SV LMS. The words "you" and "user" refer to any person accessing or using this website.

By visiting svlms.com and/or purchasing a course or service, you agree to be bound by the following Terms and Conditions. Please read them carefully before using the platform. If you do not agree, you may not access the website or use any of its services.

These Terms apply to all users, including students, tutors/instructors, corporate clients, and visitors.

Section 1 β€” Definitions

"Platform" means the SV LMS website located at svlms.com and all associated pages, tools, and services.

"Course" means any online learning content β€” including video lessons, exercises, educational games, and downloadable PDF materials β€” made available on the Platform.

"Student" means any individual who registers on the Platform and purchases or accesses a Course.

"Tutor" / "Instructor" means any individual who registers on the Platform to deliver individual lessons or create course content.

"Corporate Client" means any company, organisation, or legal entity that purchases courses or training services on behalf of its employees or workforce.

"Individual Lesson" means a one-to-one live session booked between a Student and a Tutor through the Platform.

Section 2 β€” Eligibility and Account Registration

To register and use the Platform, you must be at least 18 years old, or have the consent of a parent or legal guardian if you are a minor.

You agree to provide accurate, current, and complete information when registering. You are responsible for maintaining the confidentiality of your username and password and for all activity that occurs under your account.

You may not share, sell, or transfer your account access to any third party. A breach of this condition may result in immediate account suspension without refund.

Section 3 β€” Student Terms

3.1 Payment

The full course price must be paid before access to the course is granted. All prices are displayed on the Platform and may be subject to change without prior notice. Prices are inclusive of any applicable Italian VAT (IVA) where required by law.

Payment can be made via the online payment methods available at checkout (including PayPal and card payment). By completing a purchase, you confirm that you are authorised to use the chosen payment method.

3.2 Course Access

Upon full payment, the Student gains immediate access to the purchased course materials, including video lessons, exercises, educational games, and downloadable PDF documents.

Access to a course is time-limited. The standard access period is 16 weeks from the date of purchase. At the end of this period, access will expire.

If a Student does not complete the course within the 16-week access period, they may purchase a renewal, retaining all previously recorded progress.

A Student may request a postponement of course activation within the first week of purchase. Activation may be delayed by a maximum of 4 months from the purchase date.

3.3 Refund Policy

A Student may request a full refund within 7 calendar days of payment, provided they have not completed more than 20% of the course content. After this 7-day window, no refund will be issued.

Refund requests must be submitted by email to info@svlms.com with the subject line "Refund Request" and the order details. Approved refunds will be processed within 14 business days.

No refunds are available for individual lessons where the lesson has already been delivered, or where the Student failed to cancel with at least 24 hours' notice (see Section 3.5).

3.4 Certificates

Students who complete a Plus version course and pass the final assessment will receive a Certificate of Completion. The certificate confirms participation and successful completion of the course; it does not constitute an official government qualification unless explicitly stated in the course description.

3.5 Individual Lessons

Individual lessons must be purchased in advance before booking a session with a Tutor.

The Student is required to book each lesson no later than 4 months from the date of purchase. After this period, the right to the lesson is forfeited.

If the Student does not attend a lesson at the agreed time, the Tutor is not obliged to make up for the absence, and the lesson is considered delivered.

To cancel a lesson, the Student must notify the Tutor by email at least 24 hours before the scheduled start time. Cancellations made with less than 24 hours' notice will be treated as delivered lessons.

Tutors are not required to provide additional materials (e.g. exercises, readings) beyond what is included in the lesson, unless agreed separately.

If a Tutor or substitute is unable to deliver a scheduled lesson, they must notify the Student in advance. The Student will be entitled to a make-up lesson.

3.6 Note on the Italian Driving Licence

Where a course relates to the Italian driving licence (patente di guida), please note that the official written exam is conducted in Italian, French, or German only, as required by Italian law. SV LMS provides preparatory courses in multiple languages to help students understand the content; the language of the official exam remains fixed by law and is outside our control.

Section 4 β€” Tutor / Instructor Terms

Tutors who register on the Platform agree to deliver lessons and/or create course content in good faith, with appropriate expertise and professionalism.

Tutors are responsible for ensuring that any content they create or deliver does not infringe third-party intellectual property rights.

By submitting content to the Platform, Tutors grant SV LMS a non-exclusive licence to host, display, and distribute that content to registered students for as long as the content remains on the Platform.

SV LMS reserves the right to remove any content or suspend any Tutor account that does not meet our quality and conduct standards.

Section 5 β€” Corporate Client Terms

SV LMS offers training services to companies and organisations that wish to onboard or upskill their multicultural workforce. Corporate clients may purchase course access in bulk for their employees.

Corporate agreements β€” including pricing, course production, language availability, and reporting requirements β€” are governed by a separate written Service Agreement signed between SV LMS and the Corporate Client. In the event of any conflict between these general Terms and a signed Service Agreement, the Service Agreement prevails.

Corporate clients are responsible for ensuring that their employees who access the Platform comply with these Terms and Conditions.

SV LMS will provide learner progress reports (course completion rates, assessment scores, and participation data) to the Corporate Client as agreed in the Service Agreement. The collection and processing of employee data for this purpose is governed by our Privacy Policy and any applicable Data Processing Agreement.

Section 6 β€” Intellectual Property

All content on the Platform β€” including but not limited to video lessons, course materials, text, graphics, logos, and downloadable documents β€” is protected by copyright and other intellectual property rights owned by or licensed to Mundida / SV LMS.

You may not copy, reproduce, distribute, transmit, republish, sell, or create derivative works from any course material without the prior written consent of SV LMS. This restriction applies to both digital and printed formats.

Downloading course PDFs is permitted solely for the personal, non-commercial use of the registered Student.

Section 7 β€” Acceptable Use

You agree not to use the Platform:

  • for any unlawful purpose or in violation of any applicable law in Italy or your country of residence;
  • to infringe the intellectual property rights of SV LMS or any third party;
  • to upload, transmit, or distribute viruses, malware, or any other harmful code;
  • to harass, abuse, intimidate, or discriminate against any other user;
  • to attempt to gain unauthorised access to any part of the Platform or its underlying systems;
  • to share your login credentials or allow any third party to use your account.

A breach of these conditions will result in the immediate suspension or termination of your account without right to a refund.

Section 8 β€” Privacy and Data Protection

SV LMS processes personal data in accordance with the EU General Data Protection Regulation (GDPR) and applicable Italian data protection law (D.lgs. 196/2003, as amended by D.lgs. 101/2018).

Your personal data is collected and used to provide the services you request, manage your account, process payments, issue certificates, and communicate with you about your courses. Full details β€” including your rights as a data subject β€” are set out in our Privacy Policy.

Section 9 β€” Third-Party Links and Tools

The Platform may contain links to third-party websites or integrate third-party tools (such as payment processors). SV LMS is not responsible for the content, accuracy, or privacy practices of any third-party site or service. Clicking a third-party link is at your own risk; we encourage you to review the relevant third party's terms and privacy policy before engaging with them.

Section 10 β€” Disclaimer of Warranties and Limitation of Liability

The Platform and all courses are provided "as is" and "as available" without warranties of any kind, express or implied. SV LMS does not warrant that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components.

To the maximum extent permitted by Italian and EU law, SV LMS shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including loss of data, loss of revenue, or failure to achieve a particular result (such as passing an official exam).

SV LMS's total liability for any claim arising under these Terms shall not exceed the amount paid by you for the specific course or service in question.

Section 11 β€” Termination

SV LMS reserves the right to suspend or terminate your account at any time, without notice, if you breach these Terms. Upon termination, your right to access course materials ceases immediately.

You may close your account at any time by contacting us at info@svlms.com. Obligations and liabilities incurred prior to termination β€” including outstanding payment obligations β€” survive the termination of this agreement.

Section 12 β€” Modifications to the Service and Prices

SV LMS reserves the right to modify, suspend, or discontinue any part of the Platform or its services at any time. Prices are subject to change; price changes will not affect purchases already completed.

We will make reasonable efforts to notify users of significant changes via email or an on-site notice.

Section 13 β€” Changes to These Terms

We may update these Terms and Conditions at any time by posting a revised version on this page. The "Last updated" date at the top of the document will reflect the most recent revision. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.

Section 14 β€” Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of Italy. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Brescia, Italy, unless mandatory consumer protection law requires otherwise.
